Drybar Giveaway – Emmys Tickets

(the “Giveaway”) is sponsored by Helen of Troy L.P. (the “Sponsor”), 1 Helen of Troy Plaza, El Paso, Texas 79912 and is in no way sponsored by the Television Academy.  The Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. The Giveaway is void where prohibited by law and subject to all federal, state, and local laws and regulations. Employees of Helen of Troy Nevada Corporation and its affiliates, participating retailers, sales representatives, distributors and promotion and other vendor agencies involved in this promotion and the household members of all such employees are NOT eligible.

HOW TO ENTER

No purchase necessary to enter. Winner and one guest must pass a background check to be conducted solely by the Television Academy.  To submit an entry, each participating person (“Participant”) must, during the Giveaway Period (described below) complete the following steps: follow ‘thedrybar’ and ‘televisionacad’ official account on Instagram and TikTok, create a video using at least one Drybar product and tool of choice showing us your best Emmys hairstyle and tag us in the post while also using the hashtags #EmmysWithDrybar #Emmys2023.75thEmmys The “Giveaway Period” begins at 12:00 a.m. Pacific Standard Time (PST) on December 14, 2023, and ends at 11:59 p.m. PST on December 20, 2023. There will be one (1) winner of two (2) Emmys tickets for the Giveaway. If Winner or guest do not pass a background check by the Television Academy, Winner shall not be entitled to another prize. Sponsor’s computer is the official time-keeping device for this Giveaway. 

WINNER

One (1) winner (the “Winner”) will be selected on Thursday, December 21, 2023, by Sponsor from entries received during that Giveaway Period.   All results of the selections are final and binding, subject to these Official Rules.  In the event a winning entry is discovered to be invalid for any reason whatsoever or the person who submitted the winning entry fails to comply with these Official Rules prior to delivery of the prize, the prize may be forfeited and awarded to an alternate Winner.  No more than the advertised number of prizes will be awarded. For a winner list, send a self-addressed, stamped envelope postmarked by January 21, 2024, to: Drybar Giveaway, 1 Helen of Troy Plaza, El Paso, Texas 79912.

NOTICE TO WINNER

No later than December 21, 2023 Sponsor will individually notify the Winner via the Instagram account or TikTok account the potential winner entered with.  If a potential winner does not respond within three (3) days from the date Sponsor first tried to notify them, and/or the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to receive the prize, and an alternate winner will be selected.  Sponsor is not responsible for lost, stolen, late or misdirected mail or delivery or communication problems of any kind.

PRIZE

One (1) prize will be awarded after the Giveaway Period.  The Winner will receive:

• Two (2) Tickets to the 75th Annual Emmy Awards on behalf of Drybar.
• A two night stay at a hotel (to be determined) near the Microsoft Theater in Los Angeles where the Emmys are being held on January15th 2024.
• Two airline tickets to get you to Los Angeles to attend the 75th Annual Emmy Award Show if you do not live locally.
• One $75 Drybar shops gift cards for each of you and your guest for blowouts on January 15th, 2024, to get your hair done before the 75th Annual Emmy Awards Show.
• Stipend for food and drinks during your stay in Los Angeles, CA.
• As well as some of our best-selling liquids and tools to help you get ready for your trip to Los Angeles.

This total prize has an approximate value of $3,000.

Sponsor is not responsible for any prizes not delivered or lost during transit. All federal, state, and local taxes and fees, as well as any other expenses not specified herein, are the sole responsibility of the Winner. Prize consists only of the item(s) specifically listed as part of the prize.  Sponsor reserves the right to alter the number of Winners based on participation and availability of products. Sponsor also reserves the right to substitute any prize for a prize of equal or greater value.  No cash alternative or alternative prize is available upon Winner’s request.

CONDITIONS

BY ENTERING, Participant agrees to accept and abide by the rules of this Giveaway and agrees that any dispute regarding the conduct of this Giveaway, rule interpretation or award of prize, shall be submitted to Sponsor, whose decision shall be binding and final. By participating, Participant agrees to release and hold harmless Sponsor, Instagram and its affiliates, participating retailers, sales representatives, distributors and promotion and other vendor agencies, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations from any injury, loss or damage to person, including death or property due in-whole or in-part, directly or indirectly to the acceptance or use/misuse of the prize, expiration of validity of the prize, participation in any Giveaway related activity, or participation in the Giveaway. Sponsor is not responsible for any typographical or other error(s) in the printing of this offer or the administration of the Giveaway, lost, late, or unintelligible entries, lost connections, miscommunications, failed transmissions, other technical difficulties or failures, any error(s) or failure(s) of the Drybar Instagram page, the announcement of the prize, and/or prize confirmation and affidavit of eligibility notification(s) or mail requests that are mutilated or lost for any reason. In the event Sponsor is prevented from continuing with this Giveaway, or the integrity and/or feasibility of the Giveaway is severely undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction (each a "Force Majeure" event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Giveaway without further obligation. If Sponsor, in its sole discretion, elects to abbreviate the Giveaway as a result of Force Majeure event, Sponsor reserves the right, but not the obligation, to award the Prize from among all eligible entries received up to the date of such Force Majeure event.   By entering the Giveaway, a Participant consents to the use of his/her name, likeness, image and biographical data for advertising and promotional purposes without additional compensation, except where prohibited by law.  All entries are the property of Sponsor and will not be returned. This promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook/Instagram. Any questions, comments or complaints regarding the promotion will be directed to Helen of Troy L.P. not Facebook/Instagram.

DISPUTES

Except where prohibited, Participant agrees that: (1) these Official Rules or the rights and obligations of the Participant and Sponsor in connection with this Giveaway shall be governed and construed by the laws of the State of Texas, without regard to its conflict of laws, and (2) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action.
